PEORIA, Ill. (AP) -- The mother of a Caterpillar Inc. worker killed last year in an accident at the heavy equipment maker's plant in Mossville has filed a lawsuit against the company.
Kevin Fay, an employee of O'Brien Bros. Piping, died from chest injuries suffered when a 10-foot-long, 6-foot-high, half-inch-thick piece of steel that was being moved down a 15-foot incline at the Caterpillar Technical Center toppled on him.
In a lawsuit filed Tuesday in Peoria County Circuit Court, Nancy Fay of Metamora is seeking damages in an amount necessary to "fully and fairly compensate the estate for all losses."
Attorney Dan Cusack said Caterpillar knew or should have known the 44-year-old Fay was working in a "dangerous" situation.
Caterpillar spokesman Jim Dugan says the company has no comment on the lawsuit.
