Company Aims to Move Lawsuit Over Chemical Cloud Release

A defendant in a class-action lawsuit over the release of chemicals at a plant in El Dorado wants the lawsuit moved to federal court. The suit relates to the December chemical cloud that forced up to 500 people from their homes and the evacuation of the Union County Sheriff's Office and jail.

EL DORADO, Ark. (AP) — A defendant in a class-action lawsuit over the release of chemicals at a plant in El Dorado wants the lawsuit moved to federal court.

The El Dorado News-Times reported Saturday that that Biolab Inc. filed a motion to move the lawsuit to the U.S. District Court for the Western District of Arkansas. Biolab says the estimated 400 plaintiffs are each seeking $75,000 — making the move to federal court proper.

Clean Harbors was sued for the December chemical cloud that forced up to 500 people from their homes and the evacuation of the Union County Sheriff's Office and jail. There were no injuries.

Clean Harbors then sued Biolab — alleging that Biolab was at fault for not properly safeguarding a pool sanitizing product that's blamed for the chemical cloud.
