A lawsuit involving the death of a 35-year-old Iowa man who was killed when he became trapped in a sand storage bin at a Clear Lake concrete company will be next year.

Simon Trinidad of Latimer died in January 2009 at Andrews Prestressed Concrete. The trial has been set to begin Nov. 29, 2011 in Cerro Gordo County District Court. The Globe-Gazette newspaper in Mason City reports administrators of Trinidad's estate are suing the concrete company, claiming negligence.

The Iowa Occupational Safety and Health Bureau has fined the company more than $357,000 and issued a citation saying employees were exposed to a 12-feet deep, open hopper that wasn't protected by guardrails.

Andrews Prestressed Concrete makes structural concrete including bridge beams, pilings and deck panels.
