BOISE, Idaho (AP) — An Idaho fish farm faces penalties of up to $177,500 for allegedly violating the federal Clean Water Act.
The Environmental Protection Agency filed a complaint against Lynn Babington and ARK Fisheries Inc. of Buhl.
The agency said Monday the complaint covers violations dating back to 2005.
They include discharging pollutants without a permit, failing to submit monitoring reports and exceeding permit limits for phosphorus in October 2008 and January 2010.
Kim Ogle, an EPA manager in Seattle, says his agency has tried to work with ARK fisheries to resolve the problems but that they continue.
The $177,500 fine would be the maximum administrative civil penalty allowed under federal law.
ARK fisheries has projected it could raise up to 275,000 pounds of trout and 80,000 pounds of sturgeon at the facility.
