The statement from Public Warehousing Co. came a week after the 11th Circuit Court of Appeals in Atlanta declined Agility's request to review a ruling that allowed the charges to go forward.

The company said in a statement released this week that it is "committed to trying to resolve the dispute through dialogue with the Justice Department but is prepared to defend itself vigorously if those discussions are not fruitful."

Prosecutors in November 2009 charged the company with manipulating a complex funding formula to defraud the U.S. government in contracts to supply troops in Iraq, Kuwait and Jordan.
