DENVER (AP) — A federal judge has delayed a ruling on whether to block the release of a report into a tunnel fire that killed five workers nearly three years ago.
Attorneys for Xcel Energy and one of its contractors, RPI Coating, went to court Thursday to urge Chief U.S. District Judge Wiley Daniel to suppress the report.
The companies have been charged in the deaths at the Georgetown hydroelectric plant and want release of the report delayed until after the criminal case is over. They say it's inaccurate and could sway potential jurors.
Daniel said he's leaning toward releasing it, saying most jurors wouldn't remember the details. Xcel Energy's lawyer asked him to at least consider limiting release of a video animation of the fire that's expected to be included.
