Union Pension Fund Sues Defunct Foundry

The Shopmen's Local 527 pension fund contends Somerset Foundry and Machine Co. owes nearly $1 million after suddenly idling about 30 workers.

SOMERSET, Pa. (AP) — A union pension fund is suing a foundry that suddenly shut down in southwestern Pennsylvania in January, idling about 30 workers.

The federal lawsuit has been filed in Johnstown by the Shopmen's Local 527 pension fund against Somerset Foundry and Machine Co.

The lawsuit contends the company owes the pension fund for $916,000 in contribution that should have been made for work performed from August until the plant closed unexpectedly in January. The lawsuit contends the foundry owes another $43,000 for payments to cover fringe benefits and late payments.

The lawsuit contends the business is selling off its assets, so the pension fund wants to be paid out of those proceeds.

The Associated Press could not immediately locate company officials for comment Monday.
