Winery Sues Can Maker Over Foul Smell

BLOOMINGTON, Ind. (AP) -- A southern Indiana winery is suing a beverage can manufacturer, alleging that aluminum cans it made caused the winery's hard apple cider to develop a foul odor.

Bloomington-based Oliver Winery sued Broomfield, Colo.-based Ball Metal Beverage Container Corp. last month in Monroe Circuit Court. That case was transferred to federal court in Indianapolis last week.

The Indianapolis Business Journal reports (http://bit.ly/WI5nPm [1] ) that Oliver Winery claims the 8-ounce aluminum cans the company supplied for its cider produced a chemical reaction in contact with the cider that created a foul odor and spurred customer complaints.

The suit says the winery issued a voluntary recall of the cans of cider and has since suffered "significant damage."

A Ball Metal Beverage Container declined to comment on the suit, citing company policy.
