Today, the Manufacturers’ Center for Legal Action filed an amicus brief in the 2nd Circuit Court of Appeals arguing to overturn a U.S. district judge’s ruling that the government can use a search warrant issued under the Stored Communications Act to gain access to e-mail accounts controlled and maintained by Microsoft Corporation.
“If this ruling is allowed to stand, it will harm the ability of manufacturers in the United States to compete internationally,” said National Association of Manufacturers Senior Vice President and General Counsel Linda Kelly. “Manufacturers operate and compete in a global economy, which is why we are extremely concerned that the U.S. government’s demands bypass established international legal protocol and extend extraterritorial reach to seize personal e-mail stored on a U.S. company’s server in a foreign country.”
