Mayor: NYC Soda Decision Just 'Temporary Setback'

NEW YORK (AP) -- Mayor Michael Bloomberg says a judge's decision to strike down New York City's groundbreaking ban on big sugary drinks is merely a "temporary setback."

Bloomberg spoke Tuesday while visiting a Manhattan diner that is voluntarily complying with the policy. It's ditching 20-ounce bottles of soda and reserving 24-ounce to-go cups for iced coffee.

Eateries from corner delis to movie concession stands got a last-minute reprieve from the judge on Monday.

The judge said the rule was arbitrary and outside city health regulators' purview.

City officials point to the city's rising obesity rate and studies tying sugary drinks to weight gain. Opponents call the rule unfair and wrong-headed.
