PROVIDENCE, R.I. (AP) -- A judge delays a court hearing in a lawsuit challenging Rhode Island Gov. Don Carcieri's ability to require that private employers electronically check the immigration status of new hires.
Lawyers said Superior Court Judge Mark Pfeiffer will hear from both sides in court Tuesday morning. The hearing was originally set for Monday.
The state branch of the American Civil Liberties Union filed a lawsuit last week challenging an executive order that Carcieri signed in March to crack down on illegal immigrants.
One provision requires companies doing business with the state to check the immigration status of new hires using a federal database called E-Verify. The ACLU argues that provision is unconstitutional.
A Carcieri spokeswoman has said the governor has the authority to enforce the order.
