WATERBURY, Vt. (AP) -- Agri-Mark, Inc. must pay a $70,000 settlement for violating a state wastewater permit.

The cheese manufacturing and whey drying plant in Middlebury is accused of exceeding monthly wastewater flows, biological oxygen demand and phosphorus limits.

The state Agency of Natural Resources also said Monday that the company took in more wastewater without getting permission from the state and sampled phosphorous more often than required but did not report all of the findings as the permit required.

As part of a settlement approved last week in state Environmental Court, the company has agreed to take steps to make sure it complies with the wastewater permit and to pay a $25,000 civil penalty to the state and $50,000 to fund environmental projects.
