Muslim Workers Face Culture Clash In Minnesota

MINNEAPOLIS (AP) -- Fatuma Hassan and five of her Muslim co-workers lost their jobs at Mission Foods tortilla factory last month after they said that wearing a new uniform with pants violated their Islamic beliefs.

''For me, wearing pants is the same as being naked,'' said Hassan, 22. ''My culture, my religious beliefs, are more important than a uniform.''

Over nearly 20 years, thousands of Somali refugees have come to the Twin Cities to escape a violent civil war in their homeland. Yet they are not assimilating as fast as some other immigrant populations.

Many who maintain Muslim prayer times during the workday and wear modest clothing have been fired from manufacturers across the state. And Minnesota courts have seen an increase in religious discrimination complaints.

''For the average Minnesotan, this is entirely new,'' said Bruce Corrie, an economist at Concordia University who specializes in immigration research. ''The Somali community is highly assertive and politically engaged. ... It's part of who they are as a people.''

''We have a saying in Somalia that 'he who approaches the lion does not know what a lion is,''' said Abdi Sheikhosman, an Islamic law professor at the University of Minnesota. ''Many Somalis arrive here not knowing the history of racial divide in this country. They don't know the lion they are up against.''

Nationally, religious discrimination complaints have nearly doubled since the Sept. 11, 2001, terrorist attacks. In Minnesota, Muslims filed 45 such cases with the U.S. Equal Employment Opportunity Commission in 2007, up from eight in 2004.

For Abdisalam Adam, director of the Dar Al-Hijrah Cultural Center in Minneapolis and an imam at an area mosque, the issue comes down to cultural differences.

''You would think this would have been more of an issue in 1993 or 1994,'' when Somalis started arriving in the Twin Cities in large numbers, he said. ''But now, Somalis and employers have gotten to know each other, and the situation is only getting worse.''

Many Somalis come from tribes that move with their herds in search for safe grazing land, Sheikhosman said. These nomads are independent and believe freedom means being left alone.

Sheikhosman said each time he returns to Somalia, he is struck by ''the general chaos of the place,'' he said. At a Somali airport counter, he said, the only way to be served is to yell and push through a crowd.

''Imagine that a person comes coming from that environment is suddenly subjected to all these regulations and rules'' in the workplace, he said. ''He may think these are an intrusion to the freedom that he had at home. He's not afraid to take a stand.''

Twenty-three percent of Somali workers in Minnesota are in manufacturing jobs, according to the 2000 U.S. Census. And many of the religious discrimination complaints revolve around the Islamic prayer schedule. Praying five times a day is required, but prayer times vary based on the times of sunrise and sunset.

In 2005, 16 workers at Celestica's circuit-board manufacturing plant in Arden Hills were fired or suspended for taking unauthorized breaks at sunset.

Faysal Haliye, 43, is a former Celestica employee who said he was heading to the company's prayer room one day when a manager ordered him to return to his post. He and 22 other workers have filed a class action lawsuit against Celestica. The religious discrimination lawsuit is pending.

The Mission Foods clash has also led to a lawsuit. The Council on American-Islamic Relations, a civil rights group, filed a religious discrimination complaint with the U.S. Equal Employment Opportunity Commission.

Mission Foods had implemented the new dress code for factory workers and said the traditional Muslim clothing was too loose-fitting and posed a safety hazard near machines.

Sheikhosman says Somalis are also different from other immigrants because many hope to return to their home after the civil war, so they see assimilation as less of a priority.

In 2006, the U.S. Census Bureau estimated there were 24,430 Somalis in Minnesota, but immigrant groups say the population is higher because many Somalis don't respond to census surveys.

Mary Marsden, owner of the janitorial firm Marsden Building Maintenance, says her Somali workers are loyal.

''They are very loyal workers,'' Marsden said. ''We wouldn't employ them unless it made good business sense.''

Safety trumps culture - period. I can bet that the lawsuits would fly if someone got hurt due to non-standard dress. The lawyers started the curbs on rights through their litigious habits; now the companies are caught in the middle.

The arguemnt "We did it this way in my home country" is not flying any more. You're in the United States of America now, not your war torn 3rd world country. We cannot expect every employer in the U.S. to stop a production line or any other business action to accomodate individuals and their religious beliefs. If you are not able to fulfil the work requirements, you should not have the job (Americans With Disabilities Act not included in this discussion). It doesn't matter if it's 5 breaks a day to pray or wearing loose clothing because of safety issues, standards are there for a reason and should be respected. There are many jobs that offer the flexibility to stop what you are doing to pray as you'd like, but manufacturing generally is not one of them. Once again, if you're in a foreign country and they are nice enough to let you work, you have an obligation to abide by their safety and productivity standards and rules. We're not talking about slave labor/generally unsafe working conditions here. If my boss asks me to conduct business in a manner with which I disagree, I am FREE to go find another job! And isn't it nice that we let these people immigrate here and stay for decades, but many have no desire to become American citizens, yet they expect us to accommodate them at every turn. I have to agree witht he employers on dress code when you are around moving equipment it makes good business sense not to have loose clothing that can catch on shafts chains belts anything moving also working with food products you wnat a clean area and wearing street cloths in the facility only increases chances of health risks so if they won't comply with the dress code then they won't have a job easy as that

We as citizens of the US and love this country need to take a stand against the immigrants who come here and expect us to change to suit them. If they want to live here then they should adapt and if not return to their own country with the culture they want to live. Have they forgotten that they are only guests? Maybe if all of those who are only here for the free rides and to cause this kind of trouble left there would be enough jobs for the real citizens of this country who want to work and pay taxes and their children don't get to go to college for free because of their nationality. Talk about being unfair and discriminating.

What strikes me is the indignation the Somalis have about assimilating. Their claim is that "because many hope to return to their home after the civil war, so they see assimilation as less of a priority." Oh really? Who will take the bet that they leave once this civil war is over? Any takers? Most people would also see this as a safety issue. What happens when one of these poor Somalis gets a limb torn off because of loose clothing? How fast can you say 'lawsuit'? Muslim Somalis have the ability to find employment where dress is not a safety issue. They would be wise to pursue those jobs and not try to brandish the civil or religious rights flag to defeat dress code rules.

If I was an American Female going to Somalia (don't know why I would want to) I would respect their culture and dress and conduct myself accordingly. Try walking around in Saudi Arabia 'acting American' and see what happens. Every middle eastern female I have ever met is very happy to be OUT of the particular third world hell-hole they came from. Nobody wants to go back. It isn't the average Somali (or other Jihadist-controlled despotic country)immigrent that is causing this ruckus. It's the unreformed unenlightened seventh century clerics mullahs and imams that have a problem with American Industrial culture. I have read about what they have been doing in europe and they want to have their segregated racist islamofacist imported here. In the '90's there wasnt this problem because the islamofacists weren't established yet. Check the fruit on the tree- it ain't the average refugee from 'over there', it's the islamofacist troublemakers- sent the troublemakers packing (starting with CAIR) and let the peaceful refugees stay. The problem will disappear.

Take the law suits and dump them in Boston Harbor... Of course only if they are written on 'green' paper. Too many of us hard working Americans are paying for this foolish BS. Our tax dollars at work. Next we'll be paying for loudspeakers so they can broadcast prayer like they do in some Muslim countries. Park the first set on the whitehouse lawn and see what happens.

As a safety manager for a large manufacturer, this really hit home. When one of these people are injured because of their loose clothing, there will be more trouble than just lawsuits. OSHA doesn't care about your religious beliefs or culture when they come to investigate an accident or fatality. The company is the one who ends up paying fines of up to $70,000 for a single incident. Add to that the cost of Worker's Compensation, and the only ones who win are the lawyers. As far as I'm concerned, anyone who wants to enter our great country LEGALLY is welcome. But, if you're going to come here, learn the language, use it at all times, and adapt to our customs. If what we have here doesn't suit your taste, GO BACK HOME!!!

This country is not here for corporations. It is for the people. Religious freedom is of extreme importance. I have no problem when an employer has a compeling interest (such as safety or even brand image). But, if an employer simply does not want to be accomodating to strange prayer practices then the employer is in the wrong.

The separation of church [religion] and state means that you can worship on your own time and on your own dime, as long as you do not infringe on the rights of others to do the same or expect any special treatment from your employers, your neighbors, or your government because of your religious beliefs. I am an American Citizen with at least 8 generations along several ancerstoral paths. I accepted Islam and enjoy wearing the dress that might be associated with that religion. I feel elegant and regal in it. Christian immigrants who came to this country before and during the establishment of this government once wore the type of dress that todaymight be characterized as Islamic dress. Who are we kidding when we Americans make a distinction against loose dress and American cultural dress? Yo' mama? There can be reasonable accomodation for the issues regarding religious dress, prayer timings, and workplace safety. The type of cloth used and the form of the garment can be adjusted to comform to both needs and standards of each of the contingencies. For instance, A denim or gaberdine tunic top over a long sleeve t-shirt and a straight long skirt could suffice, As well as the "amira" style head scarf that does not flow from the body but is acceptable Islamic covering could be used... As for the prayer breaks... The Islamic prayer usually takes from 5 to 15 minutes depending upon whether a person needs to perform ablution and is or is not praying alone or with others. The law states that a 15 minute break must be allowed within every 4 hours of work, and that a 1/2 hour of meal time must be afforded at every 4 hours.(or something to that affect). People of America, wake up!!! This is a global melting pot. All kinds of differences will be observed. You can accomodate and respect them if you want to.
