Immigration Raid Leads To Federal Class-Action Lawsuit

CEDAR RAPIDS, Iowa (AP) -- Three people arrested in this week's immigration raid at a meatpacking plant in Postville have filed a federal class-action lawsuit against the Immigration and Customs Enforcement Division and several government officials.

The lawsuit was filed Thursday in U.S. District Court in Cedar Rapids. It claims Agriprocessors Inc. acquired false identification for workers, along with numerous allegations of abuse from supervisors. It also alleges the detainees haven't had adequate time for legal services.

The lawsuit was filed by Antonin Trinidad Candido, Roman Trinidad Candido and Maria del Refugio Masias, on behalf of an ''unspecific number of detained immigrant workers.'' It was filed through the Peck Law Firm and Dornan & Lustgarten firm in Omaha, Neb.

ICE agents arrested nearly 400 people on Monday in the largest immigration raid in U.S. history.

The law firms Peck and Dornan & Lustgarten should be ashamed of themsleves. Who is paying for these lawyers' services if their clients do not have a job - tax paying, law abiding CITIZENS??? If their claims are correct, maybe they should be suing the ILLEGAL employer, but not ICE, which is enforcing our laws! The bottom line is, IF their clients are "undocumented", they have broken the law by entering this country AND by using false identitification to get jobs and they deserve nothing less than to be shipped back to whatever country they came from as soon as possible. Thousands of people across the world are waiting in their home countries, going through the proper channels to enter our country legally and those that can sneak in should not be given preferential treatment!

Illegal is "Illegal" and if you are here illegally you should have no expectation of "rights or protection under the laws of the U.S." That being said both the company and supervisors should be held accountable for all of their illegal actions.

Where can I file a lawsuit against those 3 illegal's for being in MY country without proper identification. This is outragious! They got caught red handed stealing jobs and whatever else they could get from OUR country and thay have the gall to turn around and sue the United States and ICE. I want to sue them! Can a get the sleezy good for nothing lawyers at Peck to represent me? Deport all these illegals now, if they come back make them serve 20 years in a Mexican prison! This stupidity MUST stop NOW! We Americans are sick and tired of these illegals taking advantage of US and OUR country. They should get NOTHING but DEPORTED. It now appears that the legal out of work American worker has no other choice other then to be declared an illegal. In the case of 346,000 unemployed in Mich. if they are declared as illegals they may then have some rights and recourse to assistance and would be able to file a class action suit demanding extension of their unemployment insurance. As it is now the President will veto a bill that would have assisted them we are in dire straights as a nation.

I agree illegal immigrants have no legal right to represention in our courts except for the fact that the EMPLOYER who is an AMERICAN FIRM sponsored this activity. One last thing I would really like to make clear. I am a US citizen. I am an American also, however, Canadians, Mexicans and any other individual born on the North or South American Continent have the right to call themselves Americans. Before you shoot off your mouth about being "AMERICAN" take that into consideration.

As is very common, the hysteria associated with the illegal immigration issue in the news has caused many readers to shoot from the hip. First, the issues that caused the lawyers have not been elucidated. There may be serious legal principles involved. We do not know. Second, these types of cases are often taken on a pro bono publico basis. Lawyers often take these cases when there is a public interest at stake, an indigent defendant cannot afford the cost of a lawyer, or there is a significant legal issue to be tested. Third, for those who would like to deport the lawyers, I refer you to John Adams defense of the British officer after the Boston massacre. The British were hated yet Adams felt that principle demanded that Captain Preston deserved a defense, a competent defense. As often is the case the lessons of the past often elude us.

Perhaps, the best solution to the problem would be to stop BUYING services and products that are provided or made with participation of illegal workers. It is a step that anyone who cares could make.

Get real - If you were born on the North American continent, you can claim your "American-ness", but that does not automatically qualify you as a citizen OR resident of each of the 3 distinct and sovereign countries on the North American continent. Generally, Mexicans and Canadians DO NOT refer to themselves as "Americans" - they are proud of their national identity and most have no intention of relinquishing it when they come here illegally!! To legal residents, "American" means United States of America - 3rd definition in Websters's dictionary.

They should have every expectation/right of protection under US law. Protection from all the excesses law enforcement and government are capable of. They are here illegally, so I expect them to have a fair deportation hearing, and to be treated properly while detained. I also expect that those who provided false IDs or broke labour law to be held accountable as well.

Nothing stirs my blood more at this time in our history then the illegal situation. We have always considered our country as a compassionate place and made laws to help and aid the individuals that come to us. Where has that gotten us? No matter what we have done, the illegal immigrants want more. Our officials have slacked off in the past in enforcing the established laws for respectable immigrants seeking help. After years and years of allowing the illigal immigrants in this country, the drain to our infra-structure (schools, health care, welfare agencies, jobs, private social agencies) are depleated by the drain of funds supporting illegals. Where else in the world would a person "breaking the law" have the audacity to use "our laws" to sue US! We have got to wake up and start looking out for ourselves. Our house needs to be put into some kind of order before it collapes.

These laywers should be disbarred for filing such a frivilous law suit which would cut down on these cases and save lots of taxpayer money. Any employer and the illegals they hire need to be held accountable with no free rides. These law firms should be barraged with phone calls and e-mails demanding them to remove themselves from this suit and to be brought up on displinary action. I have immigrants who work with me and have followed the letter of the law to live, work, and pay taxes and these illegals annoy those guys more than it does me. It's time to step up and deport the illegals and do what is right!!!!
